FaceTime Provides IM Management and Compliance Solution to Help Address Federal Civil Procedure Rule Change
9 December 2006
Today, FaceTime Communications announced that its management and compliance products are able to help enterprises meet the demands and protect against violations of the revised Federal Rules of Civil Procedure, which took effect December 1, 2006. Under the new federal rules, companies need to keep track of all the e-mails, instant messages and other electronic documents they maintain as business records and, if involved in litigation, be able to produce their "electronically stored information" according to specific requirements as part of the litigation discovery process. Among the changes to the Federal Rules of Civil Procedure is a broad new definition of what constitutes discoverable electronically stored information. Many alert enterprises have already recognized that the change in the Rules has increased their technology needs as they review their ability to meet the new standard. Most companies have implemented solutions to archive and monitor their e-mail systems, but fewer companies have established archiving systems for instant messaging, Web conferencing and other real-time communications used by office workers. Without accurate and searchable archives of a company's electronic communications, the new rules expose companies to risks, including potentially expensive recovery efforts or fines. FaceTime products, used in conjunction with appropriate records retention solutions, help protect customers from the implications of the new law by logging and archiving instant messaging, Web conferencing and other real-time applications. In recent years, most enterprises have produced greater volumes of electronic communications via an increasing range of different applications. FaceTime's 2006 Greynets Survey, conducted by NewDilligence, shows that approximately four in ten end users have installed greynet applications that are explicitly not sanctioned or approved by their IT department. Greynets are real-time communication applications, often installed by end users, that use highly evasive techniques to circumvent existing network management infrastructure. FaceTime's IMAuditor secures and manages all public and enterprise instant messaging use over an organization's network. FaceTime works with strategic compliance partners such as AXS-One, Proofpoint and others, to provide interoperable, easy-to-manage solutions for comprehensive IM and e-mail security and compliance in a single platform. "Employees tend to say things over IM that they wouldn't necessarily say via e-mail, because they believe it to be an unmonitored channel," said Kailash Ambwani, president and CEO of FaceTime Communications. "Our customers, including nine of the top 10 U.S. banks, depend on FaceTime to easily log, audit and retrieve IM conversations occurring on their networks." About FaceTime Communications FaceTime enables the safe and productive use of greynets like instant messaging, VoIP, Web conferencing and P2P file sharing in addition to Web traffic. FaceTime Security Labs delivers the industry's first IMPact Index, which assesses "point-in-time" risks posed by viruses, worms and other malware propagating through greynet applications. Ranked number one in Enterprise IM Management by IDC in 2006, FaceTime's award-winning solutions are used by more than 800 customers, among them nine of the 10 largest U.S. banks. FaceTime supports and has strategic partnerships with all leading public and private IM network providers, including AOL, Google, Microsoft, Yahoo!, IBM, Reuters, Bloomberg and Jabber.
